The amount awarded takes into account not only the injuries themselves, but also damage to property, cost of medical care and any loss of earnings. There are generally two categories of damages awarded for any personal injury compensation claim:
This relates to any pain, suffering and loss of enjoyment of life caused by the injury. It is difficult to precisely calculate this type of damage in monetary terms, but compensation is the only remedy available for the injured party. A medical expert will conduct an examination and prepare a report which will form the evidence for an award of general damages. Compensation for loss of enjoyment includes any activity the injured party is no longer able to do due to their injury, for example, playing football.
These relate to any financial losses incurred by the injured party and as such are easier for the courts and insurance companies to quantify. This category of damages includes:
- Any damage to property relating to the accident. For example, vehicle damage as a result of a road traffic accident or injury.
- Loss of earnings. This includes both past and any future loss of earnings as a result of the accident.
- Any other expenses paid or payable as a result of the accident or injury. For example, if the injured party has had to pay for car hire or health care.
As with general damages, evidence will need to be presented to support any claim for special damages so it is important to keep track of all payments made and if possible any receipts.
